1. Products purchased from DukeSayer Ltd
1 Any dukesayer Ltd products are provided by dukesayer Ltd solely, a private limited company registered in England and Wales (company no. /09669414). References to ‘we’, ‘us’ or ‘our’ relate to dukesayer Limited.
2 The Products consist of either an online training, course, guide, consulting, or outsourcing services.
2. Status and limitation of liability
1 Your health and wellbeing is of utmost importance to us. By watching/listening/reading one of
the products, you acknowledge and agree that:
any information, mentoring or guidance provided by us, including by Duke Sayer or any person representing us, including our employees or members of our crew is not intended to be personal or specific to you and to the maximum extent permitted by law, any implied terms and warranties are excluded; and
Product is faulty due to manufacturing
to the maximum extent permitted by law, our aggregate liability arising out of or related to product, shall not exceed the amounts actually paid by you under this Agreement for the product.
2 to the maximum extent permitted by law, we will not be liable to you in any way for:
any cost, loss of income, business or profits, or for any loss or damage that was not reasonably foreseeable by us at the time you entered into this Agreement.
3 nothing in this Agreement shall be taken to exclude any liability of either party for death or personal injury caused by its negligence or any fraudulent misrepresentation.
3. Intellectual property rights
1 all material relating to these products, including registered and unregistered rights in any copyright, patents, know-how, trade secrets, trademarks, trade names, design rights, get-up, database rights, and all similar rights; and
2 you will not, at any time, do anything that would infringe our intellectual property rights, including recording, reusing, reselling or reproducing in whole or in part any product, except without our prior consent.
3 Any personal information that we store about you, including any financial information is held in accordance with our privacy policy found at www.dukesayer.com and we will not send your information to a third party without consent.
4 The intention of these products is for personal use only. Any music tracks may not be used for the support of any video, internet ads, slideshows, broadcast television, festivals, apps, CD’s, podcasts, webinars, soundtrack to digital products or DVD’s unless a royalty agreement has been agreed with dukesayer Limited.
4. Opt in
You acknowledge and agree that:
1 By registering for any event, online course, or product purchase held by dukesayer Ltd you agree to providing your name and email address.
2. dukesayer Ltd are permitted to send relevant marketing messages relating to dukesayer Ltd to the supplied email address
3. dukesayer Ltd agrees to keep your information secure and will not share your data with any third party suppliers.
4. To unsubscribe please email duke@dukesayer.com and we will remove your email immediately and no further marketing will be sent.
5. General
1 This Agreement is not enforceable by any third party (whether under statute or otherwise).
2 Any notices under this Agreement shall be via e-mail or in writing to the address provided by the other party.
3 This Agreement is the entire agreement between the parties in relation to its subject. No other terms apply.
4 Variations to this Agreement will have effect when agreed in writing by the parties. The unenforceability of any part of this Agreement will not affect the enforceability of any other part.
5 Unless otherwise agreed, no delay, act or omission by either party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.
6 This Agreement is governed by the laws of England and Wales and the parties submit to the non exclusive jurisdiction of the courts of England.
